Hawaii Felon Held After Sentence Is Up

Inmate Jay Abregana has served his federal prison sentence more than a year ago and is still being held as a sexually dangerous person according to the authorities. This makes Abregana the first person in Hawaii and the second person in the United States to be tried under the federal law that went into effect in 2006.
The law allows the government to keep prisoners confined after their sentence for mental treatment.
In Abregana’s case this is due to his actions while in prison and during some brief releases that the decision was made to hold him for mental treatment. This is a part of the Adam Walsh Act that has been added to for involuntary commitment of dangerous sex offenders including those who cause personal injury.
Pamela Byrne the Federal Deputy Public Defender lawyer that represents Abregana filed papers that he is not the violent predatory offenders that Congress portrayed when this law was passed. Incidentially
if you require a Hawaii personal injury lawyer you may want to consider Dan Pagliarini. He is a leading personal injury lawyer in Hawaii. It should be noted that
The case is now pending before U.S. district Judge Helen Gillmor and the prosecutor in the case Assistant U.S. Attorney Larry Tong did not comment. He did however file papers stating that if Abregana were released he would have serious difficulty avoiding his past behaviors.
Abregana has a history of sexual offenses that date back to 2002 when he was charged with transporting child pornography. Another 2002 case he was charged with a misdemeanor sex assault when he exposed himself to a 12 year old.
The federal statute was enacted July 20, 2007 when Abregana was to be released from the Hawaii Federal Detention Center.

Wow! I’ll Take a Dog Bite Any Day!

Wow! I’ll Take a Dog Bite Any Day!
By Michael Ehline

It was his first week on his new job but that was his conclusion. The young man was learning all about how to read meters for the local power company. He was with an older man that was showing him the ropes and teaching him the route before he was to be sent out alone. Little did he know that his mentor had a surprise for him that day.

It was a good route, one that was in the suburbs of the Hollywood Hills. There were many large estates in the area. The elder meter reader loved practical jokes and one customer in particular, loved to be his partner in them. It was a custom of theirs to “break in the new guy” and they had the perfect way to do it.

As they drove up to the next mansion, the elder meter reader told the young one to go around the back to read the meter. Just as the young man turned the corner of the house, looking for the meter, he heard a low growl and the rattle of a chain. Thinking there was a large dog in the yard he cautiously looked around for it. He did not see a dog. He saw a huge male lion at the end of the chain, head up and ears forward. The lion was looking at him like he was curiously looking at him, and that chain looked pretty short. He had heard that some people had lions for pets in Hollywood but never thought he’d run into one. He backed out slowly, hoping the chain was short and then turned to run to the front. The lion turned out to be toothless and declawed but he told the two laughing jokesters, “Wow, I’ll take a dog any day!”

Lions are rarely seen in yards, but dogs are common. Many homeowners have dogs for protection and they do a good job. Dog bites are common and happen almost every day in Orange County and it’s many cities. The pain and suffering caused by dog bites can be excruciating. Dogs seem to be naturally protective and territorial and they do bite on occasion. If you have stumbled into their yard and are bitten, you may be entitled to compensation for your pain and suffering. Contacting and experienced Dog Bite lawyer should be your first step in taking your case to court.

If you have suffered a dog bite attack and need a skilled Los Angeles dog bite lawyer, there are many animal attack lawyers throughout So.Cal. and they can be located for effects of bites like lacerations, puncture wounds, scratches, bleeding out, scars and the like. Don’t Drink and Ride Your Motorcycle

Don\'t drink and ride a bikeMost California motorcycle accident attorneys will tell you that DUI’s and motorcycles. Not a good combination. Considering the high speed and poor braking abilities of most of the motorcycles on the market, it is a good idea not to drink and ride. Almost ½ of all deaths while riding a motorcycle are due to drinking and riding.

Statistics show that the average motorcycle rider has only 2 seconds to react to sudden changes in road conditions. If the rider has been drinking, he will virtually have no chance to avoid an accident at all if a vehicle pulls out in front of him or a dog or cat darts across the road at the last minute.

Most Los Angeles motorcycle accidents and in other cities, happen within a few miles from home and more often than not involve a collision with a passenger vehicle or pick up truck. Some riders think a beer or two will not have any affect on their riding abilities. Sadly, many of them learn the hard way that just one beer can affect reaction time while riding a motorcycle.

California law states that driving with a blood alcohol level of over .08 is drunk driving. DUI’s and motorcycle laws really should have lower blood alcohol levels. But the law is the same whether riding a motorcycle or driving a car.

Orange County Motorcycle accident attorneys in cities like Santa Monica , Los Angeles or Anaheim , are experienced in motorcycle laws and the recourse to motorcycle personal injury compensation. If a passenger is riding on the back of the motorcycle, they will be entitled to representation and claims of their own when they suffer injury.

Although it seems innocent enough, going out for a few drinks while riding a motorcycle can end in disastrous results. The guy that thinks it’s a good idea to impress his first date by taking her out for a drink or two on his new motorcycle, may end up learning it is better they don’t drink and ride.

It is also quite common for many young motorcyclists to fantasize they can out run the police on their motorcycle. Having had a few drinks and then riding can bring about them putting this fantasy into action. One look at police lights behind them can set them off on a high speed chase, thinking they can outrun the police, they may sadly end in a crash. Many motorcycle accidents have been known to happen this way. Alcohol seriously impairs good judgment. Orange County Motorcycle Accident Lawyers have experience in defending these types of cases also.

If you or someone you know has been in a motorcycle accident, the first step to take after medical care is to call your Motorcycle Accident Attorney. There are experienced Orange County motorcycle attorneys that can be reached at 888-400-9721.

Top 11 Things to Do When Arrested for a DUI or Other Criminal Offense on July 4, 2008

There are few people if any that plan or want to be arrested and yet it occurs everyday to people who thought they would never be on the wrong side of the law. Being arrested can and does happen to anyone, a few beers after work with the gang from work can put a person over the legal limit to drive. It could be that the people your out for the evening with do something stupid and because your with them you are now involved. In the end it does not matter what the reason the arrest happen for but rather how you handle the situation. There are certain things that you can do that will put you in a better position when it is time to face the police.

These are vital as a way of keeping things under control in what can be a tense and
upsetting situation.

1. Use Your Manners: In other words be polite to the police officer, it is their job and nothing more in most cases. By using your manners and being polite there is a chance you will not be arrested, if you are remain polite. It is an upsetting and stressful time and by voicing opinions it can make things worse, it can also make any time in custody more difficult for you.

2. Don’t Use Voice: this means do not talk; do not offer information that can be used against you. You do have the right to remain silent, remember that and use it to your advantage. The officers might even try luring you to offer information but do not. When it is time to go to court whatever you have said can be used in court, if you have said nothing then there will be nothing to use.

3. Submit To Alcohol Testing: If you are pulled over by the police for driving under the influence you will be asked to take a breath, urine, or blood test. In the case that you are not drunk submit to the testing and if you are drunk submit to it anyway because in most states it can be refused but at the cost of your drivers license. By refusing any testing you will be forfeiting your drivers license from months to a year.

4. Search Procedures: At the time of an arrest the police will search your person and often your vehicle or the area where you are at the time of the arrest. They perform searches to protect the officers from weapons that might be on a person, as well as illegal substances. In some instances it may not be clear what officers are searching for, however without having a search warrant they can not search other rooms in your home, or inside of baggage that has been seized during the arrest.

5. What To Do During A Search: Allow the police to do their job, do not make sudden movements and do not place your hands in your pockets. Remain calm, do not for any reason put up a fight or place your hands on a police officer.

6. Stay Quiet In Custody: If you are arrested do not make threats even if you are or know someone who is important that could make this situation easier. The police do not want to hear this and it could make the time you are being held more difficult.

7. Request An Attorney: At the time you are arrested you do have the right to request an attorney. Even if you cannot afford a lawyer, you still have the right to be represented; this means an attorney will be provided for you. Being represented by legal counsel will ensure that your rights are protected and they will also advise you what questions to answer as well as ones you should not answer. Never forget that anything you say without an attorney present can be used against you in court, so stay quiet when the attorney is not present. Another function that the attorney provides is to make deals with the prosecutor when you have broken the law and this is something you cannot do for yourself.

8. Protecting Yourself: When you are pulled over by the police memorized the officers’ name and badge number if possible. If there are any pedestrians in the vicinity ask them to observe, they should not interfere with what the police are doing or saying but observe. This can be helpful in the event that you need to make a complaint against the officer.

9. Resisting Arrest: Do not for any reason resist arrest, this is a mistake that will cost you, it will amount to extra charges for resisting arrest. Running from the police is basically admitting guilt, because someone who is innocent would not run. Even if you fear the police themselves or because they carry weapons, stay put, do not run and add charges to what you will already possibly be charged with.

10. Home and Felonies: If you have committed a felony and you are in your home the police cannot arrest you without first going to a judge. The police must convince this judge that they have enough evidence to arrest you for the crime in order to get a warrant. They can arrest you when you are in a public place without a warrant. When the police come to your door without a warrant stay inside, this allows you extra time that can be used to contact your attorney and avoid an invalid arrest.

11. Using A Line: Police often use lines to bait a person, it can be anything from having DNA evidence against you, having witnesses that will testify, an exorbitant amount of drugs in your home or the other person who was also arrested is talking and you will take the fall. These are ways to get you to talk and by saying anything it will be used against you in court. Keep quiet, do not talk and wait for your attorney to be present before saying anything.
